NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Town of Jay.
On or about September 3, 2026, the Town of Jay will submit a request to the Florida Commercefor the release of Community Development Block Grantfunds under Title 1of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project for the construction of a pedestrian sidewalk and drainage improvements. The project will consist of approximately 1,700 linear feet of 5 foot-wide concrete sidewalk and associated drainage improvements including a proposed retaining wall and detectable warning pad, that are needed to maintain positive roadway and sidewalk drainage and to prevent localized ponding. The location where improvements are proposed the west side of Booker Lane starting at entrance to Bray-Hendricks Park continuing to the intersection of Booker Lane and Spring Street (Lat. 30°56’51.999”N, Long 87°9’35.701”W) in the Town of Jay. The total project budget is $625,000 and consists of a CDBG grant in the amount of $600,000 and local (Town of Jay) matching funds of $25,000.
The Town of Jay has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Town of Jay, 3695 Highway 4 and may be examined or copied weekdays 8 A.M to 4 P.M.
Any individual, group, or agency may submit written comments on the ERR to the Town of Jay attn: Donna Bullock at P.O. Box 66, Jay, FL. 32565, or call (850) 675-4556 or e-mail townclerk@townofjay.org. All comments must be received by September 2, 2026. Comments will be considered prior to the Town of Jay requesting a release of funds. Comments should specify which notice they are addressing.
The Town of Jay certifies to Florida Commerce and HUD that Shon Owens in his capacity as Mayor of the Town of Jay consents to accept the jurisdiction of the Federal Court if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Jay to use the CDBG funds.
Florida Commerce will accept objections to its release of funds and the Town of Jay certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Jay; (b) the Town of Jay has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to Florida Commerce, CDBG Program, MSC-400107 East Madison Street, Tallahassee, FL 32399-6508. Potential objectors should contact the Town of Jay to verify the actual last day of the objection period.
